| Description: | In the present study of comparative law, an overview is offered regarding Italian legislation regarding the figure of the crime of persecutory acts or, as also defined in the doctrine of that country, “stalking”. For the purpose of being as complete as possible, this work exposes the characteristics of the crime, from its objective and subjective aspects, including the protected legal good, the behaviors that it sanctions, how they should be deployed, the intent required for such purposes and the penalty planned for the crime. In the same way, procedural issues are addressed that make this crime of interest and in a complementary way, profuse jurisprudence has been analyzed in this regard, in order to assess its compliance in judicial practice. En el presente estudio de derecho comparado, se ofrece un panorama respecto de la legislación italiana respecto de la figura del delito de actos persecutorios o, como se define también en la doctrina de aquel país, el “stalking”. A los efectos de ser lo más completo posible, este trabajo expone las características del delito, desde sus aspectos objetivos y subjetivos, incluyendo el bien jurídico tutelado, las conductas que sanciona, cómo estas deben desplegarse, el dolo requerido a tales fines y la pena prevista para el delito. Del mismo modo se abordan cuestiones procesales que hacen que este delito sea de interés y de modo complementario, se ha analizado profusa jurisprudencia al respecto, a los efectos de valorar su cumplimiento en la praxis judicial. |
