Description: These pages contain some notes that seek to clarify the concept of Constitutional Criminal Law.The starting point of these reflections is consistent with the theory of the constitutional Stateof Law, which determines that the Constitution has a binding normative scope. In this way, theso-called Magna Carta constitutes the basic of criminal law, forcing the criminal legislator toperform his function by observing the constitutional postulates.
Se contienen en estas páginas algunas notas que buscan esclarecer el concepto de Derecho penal Constitucional. El punto de partida de estas reflexiones se ajusta a la teoría del Estado constitucional de Derecho, que determina que la Constitución posee un alcance normativo vinculante. De este modo, la llamada carta magna constituye el fundamento básico de la ley penal, que obliga al legislador penal a realizar su función observando los postulados constitucionales.
