Description:	The present work addresses and enunciates a possible solution to the unknowns that are thrown and arise from article 1235 of the Commercial Code in force in the Federation, and this arises because the alleged code article in question, is omitted to specify various issues that concern to the ratification produced without the judicial presence. Once the legal precept object of this work has been studied, a sequence of questions are expressed, and an opinion is subsequently dispensed based on commercial law, jurisprudence and legal practice; such opinions are regarding each point in particular questioned, as regards the confession issued without the judicial presence and for it to have full evidentiary value, it´s ratification is necessary. El presente trabajo aborda y emite una posible solución a las incógnitas que arroja y surgen del artículo 1235 del Código de Comercio vigente en la Federación, y éstas nace debido a que dicho numeral del códex en comento, es omiso en precisar diversas cuestiones que atañen a la ratificación producida sin la presencia judicial. Una vez citado y estudiado el precepto legal objeto este trabajo, se expresan una batería de cuestionamientos, para posteriormente omitir una opinión con base en la legislación mercantil, la jurisprudencia y en la práctica jurídica; sendas opiniones son respecto a cada punto en particular cuestionado, en lo que atañe a la confesión emitida sin la presencia judicial y para que ésta tenga valor probatorio pleno es necesaria su ratificación.
