Description:	From the 1990s, the accusatory criminal procedure system was imposed in most Latin American countries, with the purpose of solving the problems that were generated in the inquisitorial system, such as the slowness for the solution of the cases and the discretion with which the judges performed their actions. The last country that adopted this system was Mexico, at the federal level in 2016, after a process that began with the constitutional reforms of 2008 in the local states. In Mexico, the advances are, in general, positive, but several problems persist, one of which is the discursive deficit that occurs between lawyers and judges. The purpose of this intervention is to show how discourse studies in general, and in particular the old rhetoric, can help to solve the discursive deficit in judicial practices. A partir de la década de 1990 se empezó a implantar en la mayoría de los países latinoamericanos el sistema procesal penal acusatorio, con el propósito de resolver los problemas que se generaban en el sistema inquisitorio, como la lentitud con que se resolvían los casos y la discrecionalidad con que actuaban los jueces. El último país que adoptó ese sistema es México, quien lo estableció en el ámbito federal en 2016, luego de un proceso que empezó con las reformas constitucionales del 2008. En México, los avances son, en general, positivos, pero subsisten varios problemas, uno de los cuales es el déficit discursivo que se da tanto entre los abogados como entre los jueces. El propósito de esta intervención es mostrar cómo pueden contribuir los estudios del discurso en general y en particular la retórica antigua en la resolución del déficit discursivo en las prácticas judiciales.
