| Description: | In this document, a question of comparative law is addressed, more precisely of Italy, and which is extremely important today. I am referring to cybercrime. The importance of its study goes beyond mere intellectual curiosity or the usual idea of the study of comparative law, since, with current technologies, many computer crimes can be committed in one place and cause their effects in another. Thus, the most important types of Italian legislation on the subject that were included in 1993 and reformed in 2008 to have a perspective of their structures, sanctions and modes of execution are presented here. Finally, and once the constitutional objections that are presented have been evaluated, a critical analysis of the institutes is formulated. En el presente se aborda una cuestión de derecho comparado, más precisamente deItalia, y que resulta sumamente importante en la actualidad. Me refiero a los delitosinformáticos.La importancia de su estudio excede la mera curiosidad intelectual o la habitual ideadel estudio del derecho comparado, puesto que con las tecnologías actuales, muchos de losdelitos informáticos pueden cometerse en un lugar y causar sus efectos en otro.De ese modo, se exponen aquí, los tipos penales más importantes de la legislaciónitaliana en la materia que fueran incluidos en 1993 y reformados en 2008 para tener unaperspectiva de sus estructuras, sanciones y modos de ejecución.Para finalizar, y ya evaluadas las objeciones constitucionales que se presentan, seformula un análisis crítico de los institutos. |
