| Description: | The objective of this article is to evident the importance of the cultural legacy of the “ethnic groups” and their capacity to exercise patrimonial rights; methodological support is the study of the legal background of minorities in terms of equity and equality. Popular cultures are affected in their rights over literary, artistic, artisan works, etc. of those who are holders as custodians and carriers of cultural heritage, they constitute a type of citizen in conditions of vulnerability, both in terms of their tangible heritage assets and those ofintangible order such as uses and customs.
The federal copyright law does not apply a patrimonial type of coverage that grants real powers in the defense, protection and development of such cultural property. For which it is necessary to generate an initiative to promote the granting of such rights in the Federal Copyright Law. El objetivo del presente artículo es evidenciar la importancia del legado cultural de las “etnias” y su capacidad para ejercer derechos patrimoniales; como sustento metodológico está el estudio de los antecedentes legales de las minorías en términos de equidad e igualdad. Las culturas populares se encuentran vulneradas en sus derechos sobre las obras literarias, artísticas, artesanales, etc. de quienes son titulares como custodios y portadores del patrimonio cultural, ellos constituyen un tipo de ciudadano en condiciones de vulnerabilidad, tanto en términos de sus bienes patrimoniales tangibles como aquellos de orden intangible como usos y costumbres. La Ley Federal de Derechos de Autor no aplica un tipo de cobertura patrimonial que otorgue facultades reales en la defensa, protección y desarrollo de tales bienesculturales. |
