| Description: | The initiative for constitutional reform presented by the President of the Republicfrom April 28, 2016, to provide to the Congress of the Union of the faculty to issue anational procedural code in civil and family matters, does not justify the reason whyaims to make this power of State legislatures assured the federation. Neither exposesfeatures of the procedural legislation that will be issued if approves this reform, anddoes not refer to the principles of orality, contradiction, immediacy, advertising andconcentration, that all civil process and since then family, required to be effectiveand modern, meaning a due process. La iniciativa de reforma constitucional presentada por el Presidente de la República el 28 de abril de 2016, para dotar al Congreso de la Unión de la facultad de expedir un código procesal nacional en materia civil y familiar, no justifica la razón por la que pretende que esta facultad de las legislaturas estatales sea confiada a la federación. Tampoco expone las características de la legislación procesal que habrá de expedirse si se aprueba esa reforma, y no hace referencia alguna a los principios de oralidad, contradicción, inmediación, publicidad y concentración, que todo proceso civil y desde luego familiar, exige para además de ser eficaz y moderno, significar un debido proceso. |
