dc.descriptionThe facts of this case are related to the custody or custody process that was filed before the Chilean courts by the father of the girls M., V. and R. against Mrs. Karen Atala Riffo, considering that her sexual orientation and their coexistence with a same-sex couple would harm the three girls. In this regard, the Court had to resolve, among other elements, the international responsibility of the State for the alleged discriminatory treatment and arbitrary interference in private and family life that Mrs. Atala had suffered due to her sexual orientation in the judicial process that It resulted in the withdrawal of the care and custody of his daughters M., V. and R .. dc.descriptionLos hechos del presente caso se relacionan con el proceso de custodia o tuición que fue interpuesto ante los tribunales chilenos por el padre de las niñas M., V. y R.1 en contra de la señora Karen Atala Riffo por considerar que su orientación sexual y su convivencia con una pareja del mismo sexo producirían un daño a las tres niñas. En este sentido, la Corte tuvo que resolver, entre otros elementos, la responsabilidad internacional del Estado por el alegado trato discriminatorio y la interferencia arbitraria en la vida privada y familiar que habría sufrido la señora Atala debido a su orientación sexual en el proceso judicial que resultó en el retiro del cuidado y custodia de sus hijas M., V. y R.. Para estos efectos, la Corte analizó, entre otros, los argumentos expuestos por la sentencia de la Corte Suprema y la decisión de tuición provisoria del Juzgado de Menores de Villarrica.es-ES
